In a significant development out of El Paso, Texas, the shooter who committed one of the most lethal mass shootings in U.S. history is set to plead guilty in a state court on Monday. Patrick Crusius, who murdered 23 individuals in a racially charged attack at a Walmart in 2019, will likely take a plea deal that saves him from the death penalty.

Crusius has already confessed that he attacked Hispanic individuals on August 3, 2019, when he began shooting at Walmart shoppers at the busy store. Most victims were U.S. and Mexican residents who came to the store in the border town of El Paso to shop on weekends.

Life in Prison Without Parole

Crusius has been declared guilty to capital murde. And, he will receive a life prison term without parole. El Paso County District Attorney James Montoya verified it. And, he confirmed that Texas prosecutors will not pursue the death penalty in the case.

Montoya said the ruling was influenced by what the victims’ families wanted. “Most of the relatives want closure and want this to end,” he said. The plea deal, if approved, will provide that closure.

This plea at the state level follows Crusius’ federal court sentencing last year to 90 consecutive life terms. That sentencing came after he pleaded guilty to several hate crimes as well as weapons offenses.

A Racist, Deadly Attack

Crusius, then a 21-year-old white male, traveled over 700 miles from his house near Dallas to El Paso. Before the attack, he made a racist online manifesto, which threatened a Hispanic invasion.

Clad with an AK-style assault rifle, he opened fire both within and outside the Walmart, killing 23 individuals and wounding dozens. The victims’ ages included a 15-year-old athlete to elderly grandparents. Most were immigrants, teachers, laborers, or Mexican nationals who had entered the country across the border for ordinary tasks.

Crusius was arrested by authorities immediately after the attack. The incident stunned the country and led to heated debates regarding racism, gun control, and terrorism. 

Mental Illness and the Defense

Crusius’ defense counsel has referred to serious mental illness in the case. Defense attorney Joe Spencer disclosed that Crusius had schizoaffective disorder. The condition features symptoms such as hallucinations, delusions, and extreme mood swings.

“You’re talking about an individual with a broken brain,” Spencer said. According to the defense, Crusius had battled mental health issues for much of his life. However, the acknowledgment of mental illness did not absolve him of responsibility in court.

Families Prepare to Speak

If the state plea agreement moves forward, families of the victims will have the chance to share impact statements in court. In a similar federal hearing held in 2023, dozens of people delivered powerful and emotional speeches. That hearing lasted three days and included stories of grief, loss, and unanswered questions.

Monday’s court hearing will be with new waves of emotion. All the families have had to wait nearly six years for justice and closure.

A City Still Healing

The people of El Paso are still reeling from the trauma. The shooting created an indelible mark, not only in Texas, but all over the country. The shooting was designated a hate crime and was one of the most racially charged mass shootings in recent history.

Though life imprisonment might not please everyone, it provides a legal closure to a painful and long chapter. The plea agreement seeks to provide families with some peace, and a way forward without having to relive the horror through a lengthy death penalty trial.

The legal process will soon be over, but the effect of the El Paso shooting and the lives lost will never be forgotten.
