In a disturbing case, which has garnered national headlines, two brothers in their late teens are due to stand trial later this year, following an alleged shooting incident that occurred at a birthday party earlier this year in Georgia. The case that saw one of the teenagers being shot prompted their arrest and an angry lecture by the presiding judge during the first court appearance.
The Incident
The incident occurred in January during a birthday party that several teenagers were attending. Investigators said Dwayne Tolbert, 14, and his younger brother, Major Tolbert, 13, were allowed to attend the party, but were kicked out later, due to unspecified reasons. After being ejected, a brawl is said to have ensued. In the ensuing melee, either or both of the Tolbert brothers reportedly shot other teenagers who were attending the party.
A minor, whose age has not been identified, was shot in the leg in the incident. Fortunately, there were no deaths. As would be later emphasized by the judge, the shooting might have just as easily incurred much more serious injuries or even deaths.
Arrest and Charges
This week, the brothers were arrested and charged as adults, which also speaks of the gravity of the situation. Dwayne and Major are both charged with several felony crimes, such as aggravated assault with a deadly weapon, reckless behavior, and unlawful possession of a firearm.
What was already a serious situation was made even worse when investigators learned that the teenagers had allegedly shared video recordings of the shooting on Instagram. They allegedly boasted about the incident in the posts without appearing to be remorseful over their actions. Posting the crime on social media was one of the reasons why they were prosecuted so fquickly.
The Court Appearance
During their first court appearance, conducted via video on Thursday, the brothers faced Clayton County Magistrate Court Judge Latrevia Kates-Johnson. The judge did not hold back in expressing her dismay and concern over the boys’ actions.
“It’s senseless, and y’all could have killed somebody, literally killed somebody, murdered somebody shooting like that,” Judge Kates-Johnson told the teens in a stern and emotional rebuke. She emphasized the life-threatening consequences of their reckless behavior and reminded them that firing a gun is never a matter to be taken lightly.
When Dwayne Tolbert attempted to speak and explain that the party was hosted by their cousin, the judge quickly intervened to prevent him from making statements that could further incriminate him. She made it clear that their actions, regardless of the circumstances leading up to the incident, were extremely dangerous and unacceptable.
The Judge’s Emotional Message
Judge Kates-Johnson’s message to the young defendants extended beyond legal consequences. She addressed the broader issue of youth violence and the growing number of juveniles appearing before her courtroom.
“This is no joke, when you’re out here shooting guns!” she said. She went on to express her heartbreak, stating, “It’s heartbreaking to see y’all young people where you are, and I’m seeing it every single day.” The judge’s words served not only as a warning to Dwayne and Major but also as a cautionary message to other young people who may be drawn into violence.
No Bond Granted
At the conclusion of the hearing, Judge Kates-Johnson denied bond for both boys. She acknowledged the pain and devastation their actions have caused their family, stating, “I know your parents are devastated. She has two sons locked up.” The decision means that Dwayne and Major will remain in custody as they await further legal proceedings.
